If you have already insured with comprehensive cover, you can ask the Insurance Company to pay compensation whether the accident was caused by you or the driver who was driving your vehicle at the time of accident. However, please pay attention to the deductible amount specified in the policy (the so-called excess - including the young driver excess, inexperienced driver excess and unnamed driver excess etc.) and the claim report deadline specified by respective Insurance Company. (Usually one to two weeks or a slightly longer period with an acceptable explanation)
Relevant terms and conditions are specified in the insurance policy and Insurance Company also reserves the right for final approval. If necessary, please obtain an insurance policy sample from our Company for reference.
Example: Accident is caused by the Insured's driver
- After the accident, if circumstances permit, you should try to write down the relevant information of the involved parties and the accident scene.(Please refer to the attached form) It is best to use the mobile phone to take photos of the scene for future evidence used.
- You need to report to the police and notify the Insurance Company immediately. Obtain the accident report form, complete it and return to the Insurance Company together with the driver's ID card and driving license, front and back page of vehicle registration document, police report number and other police document (copy) etc.
- Since you are insured with comprehensive cover, you may tow the damaged vehicle either to your familiar garage or the repairing department of your vehicle's original factory for valuation. Then, return the quotation to either our Company or the relevant Insurance Company as soon as possible. The claim department will appoint Adjustor Firm to the garage to evaluate the damaged vehicle and submit the Adjustor report and Quotation form to the Insurance Company for review.
- After receiving the Adjustor report, Insurance Company will review, approve and then send Repair Instruction Form to the garage to inform them to start repairing the vehicle. (It takes about ten working days for the Insurance Company to issue the Repair Instruction Form after receiving the quotation from the garage.)
- After the garage has repaired the vehicle, you will be notified to pick up the vehicle. When you pick up your vehicle, you need to sign a Satisfaction Note and Subrogation Form and pay the excess directly to the garage (usually you also need to pay for the depreciation difference amount).
【Note: Before signing the Satisfaction Note and Subrogation Form, please make sure the vehicle is properly repaired. After signing the Satisfaction Note and Subrogation Form, you are legally confirmed that the vehicle has been repaired satisfactorily. You will not be able to claim from the Insurance Company for the same accident again or complain about the repair quality of the garage.】 - If you receive any document related to the accident (including police letter, court summon, third-party claim for compensation letter etc.), you must immediately submit them to the Insurance Company for processing and should not handle them by yourself or in advance.

Option 1: Insurance Company responsible for the claim

- If you ensure that the other driver has been convicted careless driving or dangerous driving by the court, the Insurance Company will also assist you to claim recovery for your excess, rental cost for substitute car or the daily reasonable transportation costs during your vehicle's maintenance period.

Option 2: Repair by yourself and claim recovery
(Small claim amount or close to excess)
- After the accident, if circumstances permit, you should try to write down the relevant information of the involved parties and the accident scene. (Please refer to the attached form) It is best to use the mobile phone to take photos of the scene for future evidence used.
- You need to report to the police (inform the police to make compliant towards other driver) and notify the Insurance Company immediately. Obtain the accident report form, complete it and return it to the Insurance Company together with the driver's ID card and driving license, front and back page of vehicle registration document, police report number and other police document (copy) etc.
- Take the vehicle to the garage and ask the garage to issue a quotation and hire an adjustor from an Adjustor Firm to make an evaluation of the damaged vehicle. Request the garage to perform repairs based on the evaluation report and you need to pay the maintenance costs first. If you need to rent a substitute car, you need to ask the garage to issue a certificate to determine the number of days the car has been parked in the garage (date of entry and date of exit).
- If you receive any document related to the accident (including police letter, court summon, third-party claim for compensation letter etc.), you must immediately submit them to the Insurance Company for processing and should not handle them by yourself or in advance.
- If the other driver convicted careless driving or dangerous driving by the court in the future, you may able to claim compensation from the other party for your repairing cost, adjustor report fee, rental cost for substitute car or the daily reasonable transportation costs during your vehicle's maintenance period.
- If you know the name, address and policy number of the other party's Insurance Company, you can write to that company directly to claim. If you do not know the name of the other party's Insurance Company, you may check the name and address of the registered owner based on the vehicle registration number of the other party at the Transport Department, and then write to the owner for compensation. (Due to the provisions of the Privacy Act, the police will not provide the defendant's relevant information to the victims of traffic accidents [including the driver's name, address, insurance company name and policy number.])
- The time from the accident to the court's decision ranges from half a year to nine months. As you choose to repair the vehicle by yourself or the amount of claim is below excess, the Insurance Company will only provide recovery opinions in the form of guidance and is not responsible for taking action to recover the compensation.
- If you ensure the police have sued the other party and no death or bodily injury involved, you may consider to write to the Insurance Company to cancel the claim file. Then, it will not affect the No Claim Discount when you renew your insurance. However, when you have officially cancelled the claim, the Insurance Company will not handle any claim for this accident.
